El-Rufai is challenging the legality and competence of the suit, characterizing the legal action as an abuse of the court process.
In a statement issued by his media adviser, Muyiwa Adekeye, it was confirmed that the former governor filed an application specifically aimed at quashing the charges instituted by the secret service. The motion on notice argues that the charge is incompetent, fails to disclose any offence recognized by law, and represents a gross abuse of judicial proceedings.
The matter has been scheduled for a hearing today, February 25, 2026, before Justice Joyce Abdulmalik. El-Rufai’s legal team is requesting the court to strike out the case in its entirety based on these grounds.
