COURT RESTRAINS PDP FROM SUSPENDING HUNKUYI, 6 OTHERS IN KADUNA LITIGATION

Senator Suleiman U. Hunkuyi and six other suspended members of the People’s Democratic Party, PDP, Kaduna state have obtained a court order restraining PDP chairman, its caretaker committee and others from suspending the seven members henceforth.

The order of Interim Injunction restraining the party and its committee members from suspending the alleged erring members was obtained on Thursday from High Court of Justice, Kaduna State, Kafanchan judicial division, holding in Kaduna.

“Hon. Justice S.S. Daka, in high court in Kafanachan division, in Kaduna State granted the interim order restraining PDP from suspending the seven members of the party until the hearing and determination of the case.”

The judge in a Suit NO: KDH/KAF/69/2020, ordered that “Upon Motion Ex-parte dated 20/05/2020, by J.H. Dacep, Esq., and I.B. Ahmed, Esq., praying for ‘An Order of Interim Injunction restraining the Defendants, their privies, them, and any other persons or/and members of the Party receiving instruction from them, from inviting, directing or taking any decisions affecting the Plaintiffs/Applicants in any ways or manners pending the hearing and determination of the Motion on Notice.’

“An Order restraining the Defendants from forming any Committee in regard to the Kaduna State Wards Congress Elections said to have taken place on the 14/3/2020 pending the determination of the Motion on Notice.

“An Order directing the Defendants to withdraw all letters of suspension issued to the Applicants pending the hearing and determination of this Suit.

“An Order suspending the appointment of the defendants as Kaduna State PDP Committee Members, its agents, officers, under caretaker, and any further Order(s) that this Honourable Court may deem fit to make in the circumstances of the Case, pending the hearing and determination of the Motion on Notice.

The Matter has been adjourned to 3rd June, 2020, for Motion on Notice.
